The following Terms of Service Agreement is a legally binding agreement that will govern our relationship with our users and others who may interact or interact with Trend Flow Studio.

WEBSITE DESCRIPTION SERVICES OFFERED

The Site is a technological services website that has the following description: Trend Flow Studio is a company that offers software and website development services. Our team of experienced professionals is expertly trained to handle all your online marketing and development needs.

Any and all visitors to our site shall be deemed to be “users” of the Services provided herein for the purpose of these Terms of Service.

You acknowledge and agree that the Services provided and made available through our website and applications, which may include some mobile applications, and that such applications may be available on various social media sites and numerous other platforms and downloadable programs, are the exclusive property of Trend Flow Studio.

Trend Flow Studio reserves the right to cancel and discontinue offering any of the above Services. You, as the end user, acknowledge, accept and agree that Trend Flow Studio shall not be liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our Services. Your continued use of the Services provided, following the posting of any updates, changes and/or modifications shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be undertaken by you to ensure you are aware of all terms and policies in effect. If you do not agree to the updated, revised or modified terms, you must stop using the Services provided immediately.

User further understands, acknowledges and agrees that the Services offered shall be provided “as is” and, “as such”, Trend Flow Studio shall not assume any responsibility or liability for the timeliness, missed delivery, deletion and/or any failure to store User Content, communication settings or personalization.

PRICES AND PAYMENT METHODS

All our services are indicated in American dollars.

PRICES AND CLEARANCE

Regarding the prices of the services, the client will be charged the prices established in the corresponding section, as offered on the website. Prices include value-added tax as provided by applicable laws in Peru (18%).

In addition to the purchase price, the customer will be responsible for paying all taxes generated, including value-added tax, consumption, use, privilege, ad valorem, customs, and any other type of taxes, levies, fees, or similar charges, taxes imposed, or increased under any municipal, state, federal, international or any other nation's law, rule, ordinance or regulation to the services sold to the customer. If the seller, for any reason, is forced to pay such taxes, the buyer must, upon request, immediately reimburse said amounts to the seller. The customer will provide, upon request of the seller, any tax exemption certificate.

Additionally, to the extent required by applicable laws in each country, customers agree to send us duly completed tax forms to enable us to make all required filings with tax authorities.

PRICE CHANGE

We may change prices and/or introduce new charges in addition to the prices at our sole discretion upon thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase prices, immediately and with contemporaneous notice.

PAY

The price of the services will be paid in advance by credit card or other payment method accepted on the website.

PAYMENT CONDITIONS

To provide any service, it will be necessary to cover 100% of the amount including taxes.

PAYMENT METHODS

Payments can be made via accepted credit or debit card.

We are not responsible for delays in our services in cases of unforeseen circumstances or force majeure. Under no circumstances Trend Flow Studio will pay penalties for late deliveries of our services.

COMPENSATION

All users of this document agree to ensure and maintain Trend Flow Studio, our subsidiaries, affiliates, agents, employees, officers, partners, and/or licensors are harmless or harmless from any claim or demand, which may include, without limitation, reasonable attorney's fees, fees made by third parties that may arise from any content that a user of our site may submit, post, modify, transmit or make available through our Services, use of the Services Trend Flow Studio or your connection to these Services, your violations of the Terms of Service and/or your violation of such rights of another person.

COMMERCIAL REUSE OF SERVICES

The user hereby agrees not to replicate, duplicate, copy, commercialize, sell, resell, or exploit for any commercial reason any part, use of, or access to the sites of Trend Flow Studio.

MODIFICATIONS

Trend Flow Studio will reserve the right, at any time it deems appropriate, to modify, alter, or discontinue, whether temporarily or permanently, our service or any part of it, with or without notice. Furthermore, we will not be liable to you or any third party for any alteration, modification, suspension, and/or discontinuance of our Services, or any part thereof.

LINKS

So much Trend Flow Studio like any third party may provide links to other websites and/or resources. Therefore, you acknowledge and agree that we are not responsible for the availability of such external sites or resources and, as such, we do not endorse and are not responsible or liable for any content, products, advertising, or any other materials, on or available from such sites or third-party resources.

Furthermore, you acknowledge and agree that Trend Flow Studio shall not be responsible or liable, directly or indirectly, for any damage or loss that may be a result of, caused, or alleged to be caused by or in connection with the use of or reliance on any such content, goods or Services available on or through any such site or resource.

PROPERTY RIGHTS

You hereby acknowledge and agree that the Trend Flow Studio Services and any essential software that may be used in connection with our Services (“Software”) will contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. You further hereby acknowledge and agree that any Content that may be included in any advertisements or information presented by and through our Services or by advertisers is protected by copyright, trademark, patent or other proprietary rights and laws.

Therefore, except as expressly permitted by applicable law or as authorized by Trend Flow Studio or the applicable licensor, you agree not to alter, modify, rent, rent, loan, sell, distribute, transmit, broadcast, publicly perform, and/or create plagiaristic works that are based on the Services Trend Flow Studio. 

Trend Flow Studio herein has granted your personal, non-transferable, non-exclusive rights and/or license to make use of the object code or our Software on a single computer, provided that you do not permit and not allow any third party to duplicate, alter, modify, create, or plagiarize the work of, reverse engineer, trace or attempt to locate or discern any source code, sell, assign, sublicense, grant a security interest in and/or otherwise transfer such directly into the Software.

You further agree herein not to alter or change the Software in any manner, nature, or form and, as such, not to use any modified version of the Software, including, without limitation, to obtain unauthorized access to our Services. Finally, you also agree not to access or attempt to access our Services through any means other than through the interface provided by you Trend Flow Studio for use in accessing our Services.

WARRANTY DISCLAIMER

You expressly acknowledge and agree that:

• Your use of Trend Flow Studio services and software is at your own risk. Our services and software will be provided on an “as is” and/or “as available” basis. Trend Flow Studio and our subsidiaries, affiliates, officers, employees, agents, partners and licensors expressly disclaim any and all warranties of any kind, whether express or implied, including, but not limited to any implied warranties, finality and non-infringement.
• Trend Flow Studio and our subsidiaries, officers, employees, agents, partners, and licensors make no such warranties that the services or software of Trend Flow Studio meet your requirements; the services or software of Trend Flow Studio will be uninterrupted, timely, secure or error-free; that such results that may be obtained from the use of the services or software of Trend Flow Studio will be accurate or reliable; the quality of any services, information or other materials that you may purchase or obtain through our services or software will meet your expectations; and that any errors contained in the software will be corrected.
• Any information or materials downloaded or otherwise obtained through the services or software Trend Flow Studio will be accessed at your sole discretion and risk, and as such you will be solely responsible for and hereby waive any claims and causes of action for any damage to your computer and/or internet access, downloading and/or viewing, or for any loss of data that may result from the download of such information or material.
• No advice and/or information, whether written or oral, that you may obtain from Trend Flow Studio or through our services or software, will create any warranty not expressly stated in the Terms and Conditions of Use.

LIMITATION OF LIABILITY

You explicitly acknowledge, understand, and agree that Trend Flow Studio and our subsidiaries, affiliates, officers, employees, agents, partners, and licensors will not be liable to you for any punitive, indirect, including, special, incidental, without limitation, damages that may be related to the loss of any profits, goodwill, use, data and/or other intangible losses, although we may have been advised of such possibility that such damages may occur and result from:

• The use of or inability to use our service.
• The cost of acquiring substitute goods and services.
• Unauthorized access to or alteration of your transmissions and/or data.
• Statements or conduct of any third party on our service.
• Any other matter that may be related to our service.

EXCLUSION AND LIMITATIONS

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of the exclusion of liability for incidental or consequential damages. Therefore, some of the above limitations on warranties in the warranties section and limitation of liability may not apply to you.

THIRD-PARTY BENEFICIARIES

You hereby acknowledge, understand, and agree, unless otherwise outlined in these terms and conditions, that there shall be no third-party beneficiaries to this agreement.

TRADEMARK INFORMATION

You herein acknowledge, understand, and agree that all trademarks, copyrights, trade names, service marks of Trend Flow Studio and other logos of Trend Flow Studio, and any brand features, and/or product and service names are trademarks and, as such, are and will remain the property of Trend Flow Studio. You hereby agree not to display and/or use in any manner the logo or marks of Trend Flow Studio without obtaining the prior written consent of Trend Flow Studio.

CLAIMS FOR COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

Trend Flow Studio will always respect the intellectual property of others and we ask that all our users do the same. Concerning appropriate circumstances and at its sole discretion, Trend Flow Studio may disable and/or terminate the accounts of any users who violate our Terms and Conditions and/or infringe the rights of others. If you believe that your work has been duplicated in a way that would constitute copyright infringement, or if you believe that your intellectual property rights have been otherwise violated, you must provide us with the following information:

• The electronic or physical signature of the individual who is authorized on behalf of the owner of the copyright or other intellectual property interest.
• A description of the copyrighted work or other intellectual property that you believe has been infringed.
• A description of the location of the site that you claim has infringed your work.
• Your physical address, telephone number, and email address.
• A statement, by which you declare that the alleged and disputed use of your work is not authorized by the copyright owner, its agents, or the law.
• Finally, a statement, made under penalty of perjury, that the above information in your notice is true and accurate, and that you are the copyright or intellectual property owner, representative, or agent authorized to act on behalf of the owner of the copyright or intellectual property.
